Practical information about the Clackmannanshire Council's Short Term Let Licence process. To be read in conjunction with the information relevant to the process for the whole of Scotland.
The Clackmannanshire Council has published a draft policy (draft as of 10.11.22).You will be asked to download and complete the application form which has guidance notes at pages 15-19.
You will be asked to submit the following documents as part of the application process:
Annual Gas safety certificate (for premises with a gas supply)
Current EICR (Electrical Installation Condition Report)
PAT (Portable Appliance Test) Report
Legionella Risk Assessment
Planning permission (for premises within a control area or where requested by the licensing authority)
Floorplan in order to verify the maximum number of occupants requested for the licence is appropriate. The draft policy suggests this should include room sizes, fire escapes routes and accommodation intended for guests with mobility impairment; the location of any steps, stairs, elevators or lifts in the premises, as well as the extent and boundary of the building where deemed relevant.
EPC Certificate (for premises which are dwellinghouses)
Copy of Buildings Insurance
Copy of Public Liability Insurance
Proof of consent from Owner (where the Owner is not the applicant)
Evidence of operation as a short-term let on or before 1 October 2022 e.g. booking confirmation email from Sykes for booking(s) that took place before 1 October 2022.
The relevant fee for most of our owners is that being charged for secondary letting (ie. when you let out accommodation that isn’t your only or principal home), and so it is that fee to which we’ve referred in the table below (based on maximum guest capacity):
4 or under: £450
5 or more: £550
The Council's draft policy, at appendix 4, states the Council are considering adding additional conditions to all STL Licences but it is not clear whether or when a final decision will be made. The potential additional conditions include:
Providing guests with information on the property/appliances and how to dispose of refuse
Advising guests that they must provide details of a named person over the age of 21
Advising guests as part of the booking conditions that additional noise making equipment such as decks and speakers are prohibited at the premises.
Not affixing key box etc. to public/jointly owned property without permission
Taking reasonable steps to ensure first arrival and final exit isn't between 11:00pm and 7:00am
Ensuring that window opening restrictor locks are provided to all windows which can be opened
